Beccaria’s thoughts are that
“No one is a criminal until he is found guilty of having committed a crime, consequently, to punish a person before he has been duly found guilty is to impose upon that person punishment which goes far beyond any reasonable limit.” (Monachesi, 447).
He also states that this creates pain and suffering rather than definable evidence. Another point that Beccaria is against is the death penalty (Monachesi). The death penalty laws are not necessary by Beccaria’s beliefs. His thoughts on death penalty are that we have no right to control whether people have the right to live or die even if there crime is murder. It’s counterproductive to the thought that we are here to assure people there right to live, according to society. Beccaria firmly believes that no one man should ever have the right to condemn one of their life. Another aspect to his belief of death penalty is unnecessary is that is does not have the long term deterrent effect of individuals. Yes, it may stave off murderers for a short period, but it does not have the lasting effect on people to say, I should not do this the last guy that did died. The long term effect would be to put the person behind bars for life. This gives the desired effect of saying I don’t want to be behind bars for life because of this. He has contributed so much to our modern criminal justice system that it’s basically the base model. Beccaria is known as the father of criminology for a reason. Without Beccaria we probably would not have the modern criminal justice system today, it would be a primitive form of the old ages that we would still be working on in great length. No to say that we still are not working gin great length on our current system as there are many things that are too vague or just not incorporated into the system properly to be the most effective. There may have been things that he missed or that we do not use today as our beliefs do not perfectly align with his. That may be the very reason that we will not coexist without fighting because we don’t all see eye to eye in all aspects of life and probably never will. If we ever did though I feel that we would not have our own free will to choose, we might all be mindless beings to follow one belief or forced in one way or another to follow one persons will. This is not a world Beccaria would want to live
