Rape may be carried out by physical force and abuse against a person who is unable to give consent at the time; for instance, someone who is inert, impaired, has a mental disability, or is under the legal age of consent. Originally, rape did not mean this. The word originates from the Latin word rapereto, which means to seize, carry off by force, or plunder. With this definition, one can argue that the mere assault of a person is rape. While arbitrary as it sounds to label someone a rapist for plundering in modern times, the FBI’s definition was nearly as faulty with them narrowly describing rape as the sexual assault by a man against a woman up until 2012. Various countries also have distinct ways of defining rape. Sweden’s defining says, “The person who through physical abuse or else with violence or threat of a criminal act forces another to intercourse or to engage in or tolerate a different sexual act that is of a similarly insulting nature and the circumstances overall are comparable to intercourse, will be convicted of rape and sentenced to prison, for a minimum of two and a maximum of six years.” This definition has been, in effect, since 1984, and is a far better wording than the United States of America’s aged description.
