Section 93C subsection 1 states that ‘a person who uses or threatens unlawful violence towards another and whose conduct is such as would cause a person of reasonable firmness present at the scene to fear for his safety is guilty of affray’. This means the prosecution must prove that Harriet Payne unlawfully pushed Mr Styles in an unprovoked attack and that Mr Styles showed the characteristics of a person of reasonable person. In addition, the prosecution must also prove that in regards to section 93D, subsection 1 and 2, that Ms Payne intended to use violence or was aware that her conduct could be violent or threaten
