Section 183 of corporation act states that a person must be director, officer or an employee of the company and have excess to relevant information must use that information with proper way which will be not for the advantage or gain of him or for someone else. This section imposes some duties like a person who have information must not use it with improper way. The use of information will be just for the corporation person and will not for the self-gain or for self-advantage. If a person can use it with improper way so ASIC have right to take action against that person. ASIC can take any kind of action or charge any penalty to that person. There are some key points involved in situation and after that it said breach of section 183. There are as follows: it must be done by director, officer or employee of the company and the information shared by them should be relevant and for advantage of themselves or for someone else. It is only be breach when there will be the improper use of information if all the above conditions were fulfilled so it is called breach of section 183 of corporation Act 2001. This section also states that the person can do it for the advantage or gain for whom, for themselves or for someone else. According to corporation Act 2001 section 183, there are some breaches of section 183. Frist breach is from Mr. Dawes when as a director he shares information with his wife. Secondly, it was by Mr. Foster when he shares information with his new employer. Another was done by Mr. Huckenfusser when he given information to his sister-in-law Mrs. Duck for personal benefit of both of them. But Mrs. Duck, she was not employee or director of the company but she also involved in the breach of corporation Act 2001 section 183 because she asked about personal stock information and make a deal with Mr. Huckenfusser regarding this.
