Joel Cardenas Case

Joel Cardenas was not discharged or fired for lack of work. He was counseled for continuously taking days off without pay. The final incident was on March 23, 2016 he asked to sit down with our CFO, Rich Bertoni and myself. Joel indicated that due to family needs at home which include young children and aging parents, he is needed at home. He asked to be terminated. He left us no choice but to let him go. During his exit interview he wanted to make sure that he would receive unemployment. This made me uncomfortable, as those determinations are made solely by the EDD, not the employer. We have heard rumor that Joel is working for a competitor, Richard Paivanas, whose company is named Fireman Boiler. Fireman Boiler is listed as having no workers’
