The Pros And Cons Of The Gun Free School Zone Act

Superior Essays
The Gun Free School Zone Act was enacted in 1990, which outlawed the possession of firearms on school grounds and made it a criminal act to carry unloaded firearms within 1000 feet of school grounds. The assassination attempt in 1982 of President Ronald Reagan brought about The Brady Handgun Violence Prevention Act in 1993. The Brady Act provided for a 5 day waiting period when purchasing a handgun. “The implementation of Brady has raised some constitutional challenges as of this writing, several state and local officials(25) initiated lawsuits challenging Brady, contending that the act violates the Tenth Amendment to the U.S. Constitution, which reserves to the states powers not delegated to the federal government.”

Persons 18 years and older can purchase a rifle or shotgun in any state. Anyone convicted of a crime punishable by imprisonment of one year or more, fugitives from justice, unlawful users of certain drugs, and those deemed legally incompetent are among the list of persons that are ineligible to purchase or possess a firearm. Persons that have renounced their citizenship, dishonorably discharged from the armed services, and persons convicted of domestic violence are also ineligible to possess a firearm. To purchase a firearm, a licensed dealer must fill out a federal form, which requires information about the buyer, along with the make, model and serial number of the firearm being purchased. The dealer will then initiate a background check on the purchaser to ensure he/she is eligible to own a firearm. The background check can take up to three days to complete. It is illegal to purchase a firearm through the mail or from another state, however, ammunition can be purchased without any state boundaries.
Federal law permits a person to transport a firearm, in a vehicle, from one state to another, provided that the firearm is unloaded and in the trunk of the vehicle. This federal law supersedes any state or local law. Any person wishing to travel with a firearm must be aware of any governing state, city and local

Trayvon Martin was a teenager who was shot in Florida by a neighborhood watch volunteer, named George Zimmerman. The incident took place outside and Zimmerman could have retreated, but under state law he chose to “stand his ground”. Zimmerman used the Florida’s stand your ground law by stating that he feared bodily injury and had a right to use force. Zimmerman was acquitted.
The gun control laws that currently exist do not necessarily keep firearms out of the hands of criminals, nor do they prevent mass shootings. In the case of James Holmes, who massacred 12 people and injured 58 in a theater shooting, there were no gun control laws in place that could have prevented his deadly rampage. He legally purchased a .40 caliber pistol, a tactical shotgun, a semi-automatic rifle and thousand of rounds of ammunition. If gun control laws requiring a thorough background check and purchase history of firearms had been in effect, perhaps this horrific act could have been avoided.
The Federal Assault weapons ban has not been reenacted and had it been in effect it could have prevented one of the most deadliest mass shootings in the history of the United

Shot by George Zimmerman in 2012, seventeen year old Trayvon Martin had his life cut short. Zimmerman, who volunteered for his local neighborhood watch committee in Sanford, Florida, was acquitted of the homicide of Martin. He was released because evidence to contradict his claim of self-defense was not present, also, the state of Florida adopted so called, “Stand Your Ground” laws that supports Zimmerman’s case. “Stand Your Ground” laws eliminate the duty to retreat, or an attempt to get away, from a threatening situation and permit the use of self-defense. These laws root from the Castle Doctrine, which stated one did not have the duty to retreat on their own property, “Stand Your Ground” laws expanded this policy to anywhere a person has…

He was convicted and sentenced to 6 months in prison and 2 years of supervision. Lopez’s lawyer, John R. In spite of the fact that a state permit is not required to appropriate; traders, merchants, or pawnbrokers must keep a record of all deals. These records must incorporate date of offer, portrayal of gun, sort of bore, and the name of the buyer. To maintain a strategic distance from the offer of unlawful firearms, these records are vulnerable to arbitrary police review. Albeit stringent, merchants have flexibility with respect to the details of every gun sold. There are no confinements or restrictions on ammo, bore, or magazine size.…

In addition, “As of September 2013, about 67,000 firearms were listed for sale online from private, unlicensed sellers” and “An estimated 40% of all firearms transferred in the U.S. are transferred by unlicensed individuals” (Universal Background Checks). Harvard’s own Dr. Deborah Azrael tells The Trace that “of 2,072 gun owners” the researchers surveyed, “roughly 40% said they’d acquired their most recent firearm (through sale or transfer) without going through a background check” (Masters). According to Smart Gun Laws’ “Universal Background Checks”, “Although federal law requires licensed firearm dealers to perform background checks and prospective purchases and maintain records of all gun sales, it does not requires unlicensed ‘private’ sellers to do so” (Universal Background Checks). Because private sellers are not required to perform background checks, it makes it very easy for anyone to purchase a gun.…

Hey all I know I'm a little late but if you'll allow me, I'd like to chime in for just a sec. First, I'd like to comment about the loophole. Bill Troxelll, I'm not sure exactly which state you live in but if you don't live in California, Colorado, Illinois, New York, Oregon and Rhode Island then you can LEGALLY sell your privately owned firearm to another private citizen WITHOUT needing that person to pass a background check. Of course, it should be noted that if that person is a felon and you know that, you'd be guilty of committing a crime known as a "straw purchase" (a felony).…

The law, enacted in 1791 during revolutionary times, is obsolete and holds no place in modern society. As the incidence of gun-related violence has infamously risen in recent years, the Amendment has stonewalled reform and will continue to unless action is taken. The question is, even as the Amendment is outdated and continues to paralyze the nation, how many more violent and a 100% preventable attacks on American soil will it take for Washington to finally comprehend the danger imposed by the Amendment to national security? It’s time for Washington to finally get it…

The law was put in effect to get rid of weapons and their attachments that can be used for mass shooting. Nevertheless, the gun laws are not all the same in all the States in America. For instance, in North Carolina, gun laws state a variety of limitations on acquiring or buying a firearm. The laws are specific on who can buy and be issued with a gun and who can possess a gun. There exist standards that govern the issuance of guns such as; the person been given the gun has not been convicted before or else if they have, they have been pardoned, the individual is not a fugitive, he is of sound mind among other conditions (Spitzer). These gun laws, like the ones stipulated in North Carolina, are strict and efficient, but not strict enough.…

Even though this is rare, it can happen when a person meets all the requirements that are required now and later on may go on to murder someone.…
