Some people would try to misconstrue the Second Amendment and say that some guns are not effective in keeping a “well-regulated militia”. For example, in a court ruling in United States v. Miller (1939), Jake Miller and one other person were caught taking a sawed-off double barrel shotgun over the state line in violation of the National Firearms Act of 1934. Miller argued that the Firearms act was a direct violation of the second amendment. This case was appealed directly to the Supreme Court. After reading over the Constitution, the Court concluded that “[i]n the absence of any evidence tending to show that possession or use of a [sawed-off] shotgun . . . has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument”. In a nutshell, that means while they see some use for the shotgun, the Court is saying the sawed-off shotgun is not a weapon that the military would use (Court). Also argued is the use of semi-automatic weapons. Most gun control advocates would argue that there is no need for a semi-automatic weapon in everyday life.
