Inherent Right of Self-Defense

Members may excercise individual self-defense in response to a hostile



Imminent Threat

Imminent does not necessarily mean immediate or instantaneous

Hostile Act

An attack or other use of force; also includes force used directly to preclude or impede the mission of US forces.

Hostile Intent

Imminent threat of the use of force; also includes force used directly to preclude or impede the mission of US forces.

Assets Vital to National Security

Defined as President-designated non-DOD and DOD property in which theft or sabatoge would seriously jeopardize the fulfillment of a national defense mission. Ex: nuclear weapons, areas containing strategic operational assets

Inherently Dangerous Property

Property is considered inherently dangerous if, in the hands of an unauthorized person, it would create an imminent therat of death or serious bodily harm. Ex: arms, ammunition.


 


On-scene DOD commanders are authorized to classify property as inherently dangerous

National Critical Infrastructor

Vital to public utilities or similar critical infrastructure vital to public health or safety, as determined by the President would create an imminent threat of death or serious bodily harm.

De-Escalation

When time and circumstances permit, the threatening force should be warned and given the opportunity to withdraw or cease threathening actions.

Use of Non-Deadly Force

Force is to be used as a last resort, with reasonable intensity, and have duration and magnitude based on the totality of circumstances to counter the threat.

Warning Shots

Warning shots are not authorized within US territory, except when in the appropiate excercise of force protection of US Navy and Naval Service vessels.

Serious Offenses Against Persons

To prevent the commission of a serious offense that involves imminent threat of death or serious bodily harm. Ex: murder, armed robbery

Escape

To prevent the escape of a prisoner, provided there is probable cause to believe that such person(s) have committed a serious offense that would pose an imminent threat of death or serious bodily harm

Arrest or Apprehension

When deadly force reasonably appears necessary to arrest or apprehend a person has committed a serious offense
