FENZ principal objectives

Reduce the incidence of fire and the associated risk to life and property

Additional functions of FENZ

assist with other matters as long as they can retain capacity in Section 11

Hazardous Substance emergency

All practicable means to stabilise and make safe, & protect life and property

Powers of an enforcement officer, Haz sub new org act 1996.

Emergency that does not involve fire or hazardous substance.

Make safe, protect life and property/environment.

Powers of authorised person in relation to land, building, or structure.

Access to land/buildings

Make safe/shore/pull down at the time or afterwards.

Power of authorised in relation to vegetation.

Extinguish & or prevent fire

Reduce prevent danger from any emergency.

Other powers of authorised person

Water supply, railway, vehicles impeding personnel, remove people, gas supplies, information, generally do all things necessary to protect life and property.

Power to destroy/dispose of any by-product.

After rendering safe haz sub, authorised person if they believe appropriate may destroy/dispose of any by-product.

Conclusive evidence of authority to perform function, or duty or exercise power.

Section 30 to 46 apply, subject to certain enactments.

Diplomatic privileges and Immunities act 1968

Security of defence areas.

Power to use water for any emergency and training purposes.

Use hydrants, water supplies, for exercises, duties, functions, or powers, from any supply or source.

In state of emergency - to requirements of national controller. CDEMA.

Duty to notify hazardous substance agencies in case of hazardous substance emergencies.

Notify hazardous substance agencies in accordance to section 39, as soon as practicable, include nature and location.

Duty to provide reports to hazardous substance agencies.

Every 12 months provide a report to EPA & other relevant agencies

Cost

Power of authorised person to direct personnel.

The authorised person may, instead of acting personally, direct any personnel to do anything that the authorised person is required to do under this sub part- delegate.

Powers of entry and inspection

FENZ inspector may at any reasonable time enter and inspect any land or building, for pre-planning, compliance, post-incident analysis.

Provisions part 4 search and surveillance act 2012

Power to enter homes and marae.

FENZ inspector must not enter land or building that is a home or marae, unless they have a warrant issued under Search and Surveillance Act 2012.

Power to restrict or prohibit entry to sites

To preserve evidence, to prevent tampering.
